1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Two Bears Boutique LLC, a Wyoming LLC ("we", "us", "our"), governing your use of www.2bearsboutique.com (the "Site") and any purchase you make through it.

By using the Site or placing an order, you agree to these Terms and to our Privacy Policy at [PRIVACY POLICY URL], which is incorporated here by reference. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract to place an order. We sell only to customers with a delivery address in the United States of America and do not accept orders from other locations.

3. Acceptable use

You agree not to use the Site for any unlawful purpose, to scrape or systematically extract its content by automated means, to interfere with its operation or security, to submit false or fraudulent order information, or to use another person's payment method without authorization.

4. Product descriptions, pricing, and availability

We work to describe and photograph our products accurately, but we do not warrant that descriptions, images, colors, dimensions, or pricing are complete, current, or free of error. Colors in particular may vary between screens.

Products are subject to availability, and we may limit quantities or discontinue any item at any time. All prices are in USD and exclude sales tax and shipping unless stated otherwise. If an item is listed at an incorrect price because of an error, we may cancel or decline the order even after you receive a confirmation, and we will refund anything already charged.

5. Orders and payment

Your order is an offer to buy. We may accept or decline any order for a lawful reason, including suspected fraud, a pricing or description error, or insufficient stock. A contract forms only when we send you a confirmation that your order has shipped.

By submitting payment details you confirm that you are authorized to use the payment method and you authorize us to charge the full order total, including tax and shipping. Payments are processed by Shopify Payments; we do not store your full card details.

You consent to receive order confirmations, shipping notices, and other communications relating to your purchase by email at the address you provide.

6. Shipping, delivery, and risk of loss

Delivery dates shown at checkout are estimates and not guarantees. Title and risk of loss pass to you when we deliver the package to the carrier.

You are responsible for giving a complete and accurate shipping address. We are not responsible for packages delivered correctly to an address you supplied, or for delays caused by the carrier, weather, or other events outside our control. If a package is lost or damaged in transit, contact us at 2bearsboutique@gmail.com and we will work with you and the carrier to resolve it.

7. Returns and refunds

Returns, refunds, and exchanges are governed by our Return Policy at [RETURN POLICY URL], which forms part of these Terms. Nothing in that policy or these Terms limits any rights you have under applicable consumer protection law, including rights relating to defective or misdescribed goods.

8. Intellectual property

The Site and its contents, including text, product photography, graphics, logos, and the selection and arrangement of that material, are owned by us or our licensors and protected by copyright and trademark law. You may view and print pages for your own personal, noncommercial use. You may not otherwise copy, reproduce, republish, or use our content for commercial purposes without our written permission. Two Bears Boutique and our logos are our trademarks.

9. Third party links

The Site may link to sites we do not control, including our payment processor and shipping carriers. We provide those links for convenience and are not responsible for their content or practices.

10. Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR REQUIRED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SITE OR ANY PRODUCT.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Two Bears Boutique LLC and its owners, employees, and agents from any claim, loss, or expense, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Site or a product.

13. Product use and safety

Each product is intended for the use described on its product page. The product page, the packaging, and any inserts supplied with the item carry the specific instructions, warnings, care information, and age guidance that apply to that item, and those take precedence over any general description elsewhere on the Site.

Please read and follow them before use. Keep products away from children unless the product page states that the item is suitable for them. We are not responsible for damage or injury resulting from use of a product other than as described, or from a failure to follow the instructions and warnings supplied with the item.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in Crook County, Wyoming and you consent to the jurisdiction of those courts. Either of us may still bring an individual claim in small claims court.

15. Changes to these Terms

We may update these Terms at any time. The version in effect when you place an order governs that order. The current version is always posted here with the date it was last revised.

16. General

• Entire agreement. These Terms, with the Privacy Policy and Return Policy, are the entire agreement between us on this subject.
• Severability. If any provision is unenforceable, the rest stays in effect.
• No waiver. If we do not enforce a provision, we have not waived it.
• Assignment. You may not assign these Terms. We may assign them in connection with a sale of the business.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
